DLgs.311: competitive below cost rates and software by Tortuga. Who is better off?

What has been changed for the designers (architects and thermo-technicians) with the

introduction of the Executive Order 311 and the tax concessions, besides the

liberalization of the professions (the laws of rates)? Has the way of planning been

changed? Has the mentality regarding the expenditure of energy been modified?

It seems to me that since the coming into force of Law 10/91 till nowadays the problem

of the energy conservation has been relegated to an almost marginal secondary role with

the Executive Order 311 and more at the mercy of political goodwill and local

government than the following governments from 1991 up till now passing in the

foreground the one related to the competencies and the rates instead.

Before facing this painful subject we have to remember that the Executive Order 311

springing up of calculation programs, procedures, courses and schools, regional laws,

interpretations and modifications subjective to some municipalities in marked contrast

with the directories of the existing laws (therefore unconstitutional). It is inevitable that

with this situation serious professional people who are prepared and ethical attentive

can’t perform their job as they would like to do, above all due to the economical aspect.

Nowadays the rates to be applied, since there doesn’t exist a “REGISTER OF AUDITORS

official attitude from the chairmen of the orders.

deduction of 55% when renovating. This is the same for the accountants, the tax

experts, the notaries who also have a role in the file of certifications.

Furthermore since there aren’t any lists at the municipalities who should draw up the

energetic qualification testimonial? Who is entitled to it? The registered member at the

register of thermo-technicians, or the architect, or the structural engineer, or the explumber

who puts himself in the business of certifications? Very significant is the

affirmation of a techno-technician export read in the Forum of Anit in order to understand

the frame of mind in the field: “This proliferation of Laws and Rules has certainly messed

us up but we have also to recognize that our role of thermo-technician has become more

important and this can also be recognized economically”.

In reality the problem nowadays is not only the 50 or 100 Euro per small building or per

flat for a certificate nor the calculations but the ability to diagnostic correctly the

problems related to the consumptions of a building. Another element of “inconvenience”

for the authorized people are the calculation programs, which ones to buy (and to use)

seeing the results of the ROUND ROBIN TEST published in the last T&P issue. The 14

software used in the calculation with a sample building, the same for all gave disarming

results because they were very different among them; therefore the conclusion seems to

be only one: the way to cover becomes longer if you think at the indications of

Instruction 2002/91/CE which envisages (art. 6, paragraph 9) the creation of simple

analysis tools with univocal and repeatable results thus minimizing the charges for the

users.
